ASHEVILLE, N.C. (828newsNOW) — Asheville police have identified a 71-year-old man who died after being struck by an SUV on Tunnel Road last month. The driver will not face charges.

Andrew Joseph Kolvick was struck Sept. 10 near the intersection of Tunnel and Riceville roads in east Asheville. Police released his name Wednesday, Oct. 7, after notifying his family.

Officers responded to the 1140 block of Tunnel Road about 8:16 p.m. Sept. 10 after receiving a report of a pedestrian struck by a vehicle.

According to the preliminary investigation, a 2016 Nissan Rogue was traveling east on Tunnel Road through a green light at the Riceville Road intersection when it struck Kolvick.

Kolvick was taken to Mission Hospital, where he died from his injuries. The driver remained at the scene.

After completing their investigation and consulting with the Buncombe County District Attorney’s Office, Asheville police said no charges would be filed against the driver.

Police did not explain what led to the decision not to file charges.
